1. Agreement to Terms

By accessing or using the My Benefits Canada website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services Description

My Benefits Canada provides concierge services to assist eligible Canadians with Disability Tax Credit (DTC) applications, Child Disability Benefit (CDB) claims, retroactive tax adjustments, RDSP guidance, and appeals. We are not tax advisors, lawyers, or medical professionals.

3. Not Affiliated with CRA

My Benefits Canada is an independent service provider. We are not affiliated with, endorsed by, or connected to the Canada Revenue Agency (CRA) in any way.

4. Fee Structure

Our standard fee is 25% of the retroactive refund recovered from CRA, payable only upon successful approval and receipt of your refund. No upfront fees are charged. No fees are charged if your application is denied. Our fee applies only to retroactive refund amounts, not to ongoing future benefits. Our fee structure complies with the Disability Tax Credit Promoters Restrictions Act (DTCPRA).

5. CRA Authorization

To act on your behalf with the CRA and your medical practitioners, we require your signed authorization. You may revoke this authorization at any time by notifying us in writing.

6. Client Responsibilities

As a client, you agree to: provide accurate and truthful information; respond to requests in a timely manner; notify us of any changes to your medical condition or personal circumstances; not misrepresent your condition or eligibility.

7. No Guarantee of Approval

While we strive to prepare the strongest possible application, we cannot guarantee that the CRA will approve your DTC application. Approval decisions are made solely by the CRA.

8. Data Handling

All personal information is handled in accordance with our Privacy Policy and PIPEDA requirements. Personal information is stored exclusively on Canadian servers.

9. Limitation of Liability

My Benefits Canada shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services.

10. Termination

Either party may terminate the service agreement at any time with written notice.

11. Governing Law

These Terms of Service are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

12. SMS Messaging

By providing your mobile phone number and opting in to our SMS messaging service, you consent to receive text messages from My Benefits Canada. These messages may include information regarding your Disability Tax Credit (DTC) application status, appointment reminders, and other important updates related to your case.

  • Message Frequency: Message frequency varies depending on the status of your application and case activity. You can typically expect to receive 2–5 messages per month.
  • Msg & Data Rates: Message and data rates may apply. Please check with your mobile carrier for details.
  • Opt-Out: You can opt out of receiving SMS messages at any time by replying STOP to any message you receive from us. You will receive a final confirmation message, and then no further messages will be sent.
